These Terms of Service ("Terms") govern your access to and use of the website www.boogiethreadsco.com (the "Site") and the purchase of products from Boogie Threads ("we," "us," or "our"). By accessing, browsing, or placing an order on the Site, you agree to be bound by these Terms. If you do not agree, do not use the Site or purchase products.

You must be at least 18 years old (or the age of majority in your jurisdiction) to use the Site.

1. Acceptance of Terms

By using the Site or placing an order, you accept these Terms and our Privacy Policy (linked in the footer). These form a binding agreement between you and Boogie Threads. We may update these Terms at any time; continued use after changes constitutes acceptance. Material changes will be posted on the Site.

2. Products and Orders

All products are custom-printed apparel (e.g., t-shirts with unique slogans/designs) made to order via third-party fulfillment partners (Printful).

  • Orders are subject to acceptance and availability. We reserve the right to refuse or cancel orders (e.g., due to pricing errors, stock issues, or suspected fraud).
  • Prices are in USD, exclude taxes and shipping (added at checkout).
  • You are responsible for providing accurate order details (shipping address, sizing, design selections). We are not liable for errors in information you provide.
  • Production starts after payment confirmation; custom orders cannot be modified or canceled once production begins.

3. Payment

Payments are processed through secure third-party gateways. By placing an order, you authorize us to charge the total amount (including taxes/shipping). All payments are final upon confirmation unless otherwise stated in our Return Policy.

4. Shipping and Delivery

  • Orders are fulfilled and shipped directly by our third-party partner (Printful). Estimated shipping times are provided at checkout but are not guaranteed.
  • We are not liable for delays, lost packages, or issues caused by carriers.
  • Risk of loss passes to you upon handover to the carrier.
  • You must inspect products promptly upon receipt and report issues per our Return Policy.

5. Returns, Refunds, and Defective Items

Due to the custom and personalized nature of our products (printed to your specifications), we do not accept returns, exchanges, or cancellations for buyer's remorse, size issues, or change of mind.

  • Defective/damaged items: Report within 14 days of receipt with photos and order details to [your-email@example.com]. If confirmed defective (manufacturing/print error), we will offer a reprint, replacement, or refund (at our discretion).
  • Refunds exclude original shipping fees and are processed within 5–10 business days after inspection.

6. Intellectual Property

  • All designs, slogans, logos, and content on the Site (excluding your uploaded/custom content) are owned by Boogie Threads or our licensors and protected by copyright, trademark, and other laws. You may not reproduce, distribute, or use them without written permission.
  • If you provide or select designs/slogans, you represent that you own or have rights to them and they do not infringe third-party rights (e.g., trademarks, copyrights). You grant us a worldwide, royalty-free license to reproduce, print, and fulfill orders using your content.
  • We reserve the right to refuse orders with potentially infringing content.

7. User Content and Conduct

You are solely responsible for any content you submit or select. We may remove or refuse content that is unlawful, offensive, infringing, or violates these Terms.

8. Limitation of Liability

To the fullest extent permitted by law:

  • Products are provided "AS IS" and "AS AVAILABLE" without warranties of any kind (express or implied), including merchantability or fitness for a particular purpose.
  • We are not liable for indirect, incidental, consequential, special, or punitive damages (e.g., lost profits, data loss) arising from use of the Site, products, or third-party fulfillment.
  • Our total liability is limited to the amount you paid for the specific product in question. We are not responsible for delays or issues caused by third parties (e.g., printers, carriers).

You agree to indemnify and hold harmless Boogie Threads (and our partners) from claims, losses, damages, or expenses (including attorneys' fees) arising from your violation of these Terms, infringement claims related to your designs, or misuse of products.
